Privacy Policy

This Privacy Policy explains how Birdseye Views, Inc. ("Birdseye Views", "we", "us") collects, uses, and shares personal information in connection with our website and the Birdseye Views platform (the "Service"). It applies to information we handle as a controller — that is, where we determine how and why the information is used.


Important: data you upload is governed by the DPA, not this policy

Birdseye Views serves businesses (our "Customers", typically automotive dealer groups). When a Customer uploads or connects data through the Service — including data about that Customer's own customers, deals, leads, and operations ("Customer Data") — Birdseye Views processes that data on the Customer's behalf and under the Customer's instructions. For that data we act as a processor / service provider, and our handling is governed by our Data Processing Addendum and our agreement with the Customer, not by this Privacy Policy.

If you are an individual whose information was provided to us by a dealer or other business, please direct privacy requests to that business, which controls the data. We will assist our Customers in responding to such requests as required.

This Privacy Policy covers the information we control: account, billing, marketing, support, and website-usage information.

Information we collect

  • Account information — name, business name, email address, role, and credentials you provide when you register or are invited. Authentication is handled by our identity provider; we do not store your password.
  • Billing information — plan, billing contact, and transaction records. Card and payment details are collected and stored by our payment processor, Stripe; we do not store full card numbers.
  • Usage and device information — log data, IP address, browser/device type, pages viewed, and actions taken within the Service, used to operate, secure, and improve it.
  • Communications — messages you send us (for example, support or sales inquiries) and related contact details.
  • Cookies — see our Cookie Policy. We use only strictly-necessary and functional cookies; we do not use advertising or cross-site tracking cookies.

How we use information

  • To provide, maintain, secure, and improve the Service.
  • To authenticate users and protect against fraud and abuse.
  • To process payments and manage subscriptions.
  • To respond to inquiries and provide support.
  • To send service and administrative messages, and — where permitted — relevant product communications you can opt out of.
  • To comply with legal obligations and enforce our agreements.

Legal bases (where applicable)

Where data-protection law requires a legal basis, we rely on: performance of a contract (to provide the Service); our legitimate interests (to secure and improve the Service and run our business); your consent (where we ask for it); and compliance with legal obligations.

How we share information

  • Sub-processors / service providers. We share information with the vendors that help us run the Service. The current list, with purposes and locations, is maintained in our Data Processing Addendum. We require these providers to protect the information and use it only to provide services to us.
  • Legal and safety. We may disclose information where required by law, to respond to lawful requests, or to protect the rights, safety, and security of Birdseye Views, our users, or the public.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.

We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising, as those terms are defined under U.S. state privacy laws.

Retention

We retain personal information for as long as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it. Retention and deletion of Customer Data are governed by the Data Processing Addendum.

Security

We maintain administrative, technical, and physical safeguards designed to protect personal information. For details, see our Information Security Policy. No method of transmission or storage is completely secure, but we work to protect your information and to disclose incidents as required by law.

Your privacy rights (U.S. state laws)

Depending on where you live, you may have rights under laws such as the California Consumer Privacy Act, as amended by the CPRA (California), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), and the Texas Data Privacy and Security Act (TDPSA). These may include the right to access, correct, delete, or obtain a portable copy of your personal information, and to opt out of certain processing. Because we do not sell personal information or use it for targeted advertising, those opt-outs generally do not apply.

To exercise a right, contact us at info@birdseyeviews.com. We will verify your request and respond within the timeframe required by law. You will not be discriminated against for exercising your rights. If your information is Customer Data held on behalf of a business, we will refer your request to that business.

Children

The Service is intended for business use and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us information, contact us and we will delete it.

International users

We operate in the United States, and the information we control is processed in the United States. If you access the Service from outside the United States, you understand that your information will be processed here.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, provide additional notice.
